Returning a Defective Product
ACKSYS will carefully test and evaluate all returned products, will repair products that are under warranty at no charge, and will return the warranty-repaired units to the sender with return shipping charges prepaid. If after ACKSYS receives the defective unit and it is not deemed a manufacturer defect or if the product in no more covered by the warranty you will be notified of the repair or replacement charges. Customers must respond within 30 days of notification with a P.O. number or a credit card to cover repair costs or we will dispose of the returned material.
If the problem or condition causing the return cannot be duplicated by ACKSYS, the unit will be returned marked, No Problem Found. We reserve the right to charge for the testing of non-defective units, return shipping charges will be invoiced.
Returning a NON-DEFECTIVE Product
NON-DEFECTIVE returns will be accepted directly by ACKSYS within 30 days from the invoice date, at ACKSYS’s discretion for credit note or exchange. NON-DEFECTIVE returns MUST be 100 percent complete and in new condition, contain all original boxes and packing materials, along with other accessories and documentation provided by ACKSYS. All NON-DEFECTIVE returns are subject to a 20 percent restocking fee, such return is not applicable to products not kept in stock (specific products or MOQ).
Statement of Limited Warranty
ACKSYS, manufacturer of ACKSYS products, warrants to Buyer that products, except software, manufactured by ACKSYS will be free from defects in material and workmanship.
For ACKSYS’ boxed non-OEM products, ACKSYS’ obligation under this warranty will be limited to repairing or replacing, at ACKSYS’ option, the defective parts within within 60 months of the date of shipment from the point of manufacture.
For ACKSYS’ OEM products and accessories, ACKSYS’ obligation under this warranty will be limited to repairing or replacing, at ACKSYS’ option, the defective parts within 12 months of the date of shipment from the point of manufacture.
Products may be returned by Buyer only after permission has been obtained from ACKSYS. Buyer will prepay all freight charges to return any products to the repair facility designated by ACKSYS.
ACKSYS further warrants that any software supplied as part of a product sale, except obsolete products, will be free from non-conformances with ACKSYS published specifications for a period of 90 days from the time of delivery. While ACKSYS endeavors to improve the features and performance of software associated with its products, no effort on the part of ACKSYS to investigate, improve or modify ACKSYS software at the request of a customer will obligate ACKSYS in any way.
This limited warranty does not cover losses or damages which occur in shipment to or from Buyer or due to improper installation, maintenance, misuse, neglect or any cause other than ordinary commercial or industrial applications. This limited warranty is in lieu of all other warranties whether oral or written, expressed or implied. ACKSYS’ liability shall not exceed the price of the individual units, which are the basis of the claim. In no event shall ACKSYS be liable for any loss of profits, loss of use of facilities or equipment, or other indirect, incidental or consequential damages.
